We have been forced to shut down work on the renovation for the winter. We have completed the installation of the new stainless steel back wall and the stainless steel apron below the gutter. We have also removed the old lining in preparation for installing the new lining. We need a week with above 40-degree temperature to be able to heat weld the lining material together. We have poured one-third of the new decking but were stopped by the weather also. Another week in the spring will finish the pouring. We have ordered the new heater which is a custom-built item with a long lead time. It will be installed when it has been manufactured and shipped to us. A winter project. The pool will be up and operational on opening day this year.

And for those who have expressed concern that the pool might pop out of the ground during the winter, fear not. It is not a concrete boat. It is a steel walled pool with a complete drainage system behind the walls.

There have been a number of issues with what can and cannot be done in Ledgewood. I might suggest that both our old and new residents' take a few minutes to review both the Ledgewood By-Laws and Regulations and the Ledgewood Covenants and Restrictions. These can both be found and downloaded directly from the Ledgewood Association web-site (Ledgewoodassociation.com).

Homeowners that are planning renovations should make sure that they have the appropriate building permits. If you go forward with the renovation without a building permit it could prove quite costly. Building permit requirements can be found on the Strongsville City website (Strongsville.org). If you are found out of compliance with the ordinance the cost of the permit could be tripled. By erring on the side of caution it could save you a lot of money. Make sure that your contractor also understands these requirements.

At the annual meeting, a question was raised as to when Ridge Creek West would be repaved. The answer is that it is on the top ten list, and if money is available it will be done. The issue of the barking dog was resolved, and the city Service Department has been contacted about putting a trash receptacle at the bus stop on Royalton Rd and Falling Water

Sledding Hill Status

Many of the members have asked about the status of the sled riding hill. Most of you are aware that this property was sold in August by Bob Schmitt Homes and that the new owners want to build a house on the property. The Association learned about the sale and the new owners’ application to have the property rezoned from multi-family to single family. The Association retained legal counsel to oppose the zoning change and presented an argument to Planning Commission based in part upon two previous legal opinions from the City of Strongsville Law Department advising that the property could not be rezoned simply by applications to the Planning Commission. Unfortunately, the City’s Law Department changed its legal position and advised Planning Commission that the rezoning of this property from multi-family to single family was appropriate and could be approved by Planning Commission alone. The Board then met to discuss other options and decided to retain counsel to file an adverse possession claim in Cuyahoga County Common Pleas Court. The Association has maintained the property for over 40 years, and is asking the Court to declare that it is the rightful owner of the parcel.

The case is still in its initial stages, and the property owners have hired a lawyer to defend the lawsuit. The case is captioned Ledgewood Association v. David Jurich, Jr., et al., Cuyahoga County Common Pleas Court Case No. CV-13-817582. The docket is available for review at cpdocket.cp.cuyahogacounty.us. All formal communication regarding the sled riding hill and the status of the litigation will be handled by legal counsel and the Board. The Board understands that there is a great deal of concern over the development of this property, but would appreciate if comments regarding the litigation and the status and use of the property be handled solely by the Board of Trustees and its attorneys.

Assessment

Assessments are now past due. In order to avoid interest and late fees the assessment must be paid by January 31st. If there is a hardship, it has to be put in writing and approved by the board.
